Who Represents Whom? |
| The Arizona Department of Real Estate dictates that we must disclose to all parties in a transaction, who represents whom.
Three forms must be signed in order to clarify the above question, as follows:
- Real Estate Agency Disclosure and Election Form
Buyers may elect to have me represent them as a Buyers' Broker.
The Buyer may elect to have the Agent show Buyer properties listed with the Broker's firm. The Buyer agrees that the Broker shall act as Agent for both parties.
- In dual representation, the Agent may not disclose to either party, whether Seller will sell for less, or whether the Buyer has more money than is being offered. A
Consent To Limited Dual Representation must then be signed.
- The Buyer must execute a Buyer-Broker Employment Agreement, according to state law at some point during the offer/escrow.
